【摘要】:黨和國(guó)家一直高度重視“三農(nóng)”問題,國(guó)務(wù)院連續(xù)多年以中央一號(hào)文件的形式要求加強(qiáng)“三農(nóng)”建設(shè),做好“三農(nóng)服務(wù)”,在全國(guó)各地開展新農(nóng)村運(yùn)動(dòng),推動(dòng)農(nóng)村新型社區(qū)建設(shè),建設(shè)成“生產(chǎn)發(fā)展,生活寬裕,鄉(xiāng)風(fēng)文明,村容整潔,管理民主”的新農(nóng)村。在農(nóng)村新型社區(qū)的建設(shè)過程之中,必將與農(nóng)村土地發(fā)生緊密聯(lián)系。如何處理好兩者的關(guān)系,利用好農(nóng)村土地,發(fā)揮土地的最大價(jià)值成為當(dāng)務(wù)之急。在現(xiàn)有的法律制度框架內(nèi),我國(guó)在農(nóng)村土地的立法方面一直保持著非常謹(jǐn)慎的態(tài)度,過分強(qiáng)調(diào)農(nóng)村土地的穩(wěn)定,擔(dān)心農(nóng)村土地的流轉(zhuǎn)會(huì)動(dòng)搖國(guó)家生存發(fā)展的根本。正是由于這種保守的立法思想,所以我國(guó)在土地流轉(zhuǎn)上呈現(xiàn)出比較僵化的思想,與社會(huì)主義市場(chǎng)經(jīng)濟(jì)是不相一致的,與農(nóng)村新型社區(qū)的建設(shè)也是相違背。 本文除去引言和結(jié)論以外,主要有四個(gè)部分:第一部分主要是分析和研究農(nóng)村新型社區(qū)建設(shè)中土地流轉(zhuǎn)的基礎(chǔ)性理論,為下文的展開奠定基礎(chǔ)。這些基礎(chǔ)性理論主要包括農(nóng)村新型社區(qū)理論、土地利用理論、土地發(fā)展權(quán)理論、農(nóng)村新型社區(qū)建設(shè)與土地利用兩者之間的邏輯關(guān)系。第二部分主要是分析和研究農(nóng)村新型社區(qū)建設(shè)中土地流轉(zhuǎn)存在的問題,通過文章的研究發(fā)現(xiàn),我國(guó)現(xiàn)階段在土地流轉(zhuǎn)上存在的問題主要有五個(gè),分別是農(nóng)村土地所有權(quán)主體缺位、土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)受限、宅基地使用權(quán)流轉(zhuǎn)受限、建設(shè)用地使用權(quán)流轉(zhuǎn)受限和農(nóng)村土地規(guī)劃不足等五個(gè)問題。第三部分主要是分析和研究農(nóng)村新型社區(qū)建設(shè)中土地流轉(zhuǎn)問題的成因,通過文章的研究發(fā)現(xiàn),原因主要集中在兩個(gè)方面,首先是我國(guó)土地法律制度設(shè)計(jì)不合理,其次是政府監(jiān)管管理。第四部分主要是根據(jù)上文指出的問題,有針對(duì)性地提出發(fā)展完善的原則和對(duì)策。從完善法律制度的角度來說,這些對(duì)策主要有以下五個(gè)方面,分別是確立農(nóng)村村民的成員權(quán),目的在于明確所有權(quán)的歸屬;加強(qiáng)土地承包經(jīng)營(yíng)權(quán)、宅基地使用權(quán)和建設(shè)用地使用權(quán)的流轉(zhuǎn);加強(qiáng)農(nóng)村土地利用的規(guī)劃,落實(shí)村級(jí)規(guī)劃制度。 我國(guó)應(yīng)當(dāng)從國(guó)情出發(fā),從法律制度上為農(nóng)村土地利用松綁,加大農(nóng)村土地的流轉(zhuǎn)的同時(shí),減少農(nóng)民對(duì)土地的依賴性。只有法律制度為農(nóng)地流轉(zhuǎn)松綁,才能從根本上提高土地的利用效率,才能從根本上培養(yǎng)農(nóng)村發(fā)展內(nèi)源性力量,從而能夠?yàn)檗r(nóng)村新型社區(qū)的建設(shè)提供更多的支持。對(duì)于農(nóng)村土地來說,主要可以分為承包經(jīng)營(yíng)地、宅基地和建設(shè)用地,如何從法律制度的設(shè)計(jì)上為這三大土地提供更多被利用的機(jī)會(huì),增進(jìn)農(nóng)村地區(qū)的經(jīng)濟(jì)增長(zhǎng)點(diǎn),推動(dòng)農(nóng)村新型社區(qū)的建設(shè)成為當(dāng)務(wù)之
[Abstract]:The party and state have always attached great importance to the issue of "agriculture, countryside and farmers", and the State Council has for many years called for strengthening the construction of "agriculture, countryside and farmers", doing a good job of "three rural services" and carrying out a new rural movement throughout the country in the form of the first document of the Central Committee. To promote the construction of new rural communities and build a new rural area with "productive development, comfortable living, civilized style of the countryside, clean and tidy villages, democratic management", and in the course of the construction of the new type of rural communities. How to deal with the relationship between them, how to make good use of rural land and give full play to the maximum value of land has become an urgent matter. Within the framework of the existing legal system. China has always maintained a very cautious attitude in the legislation of rural land, overemphasized the stability of rural land. In addition to the introduction and conclusions of this paper, there are four main parts: the first part is mainly to analyze and study the basic theory of land transfer in the construction of new rural communities. These basic theories mainly include the new rural community theory, the land use theory, the land development right theory. The second part is mainly to analyze and study the problems existing in the land circulation in the rural new community construction, through the research of this article found. There are five main problems in the land circulation in our country at the present stage, which are the absence of the main body of the rural land ownership, the limitation of the transfer of the land contractual management right and the restriction of the circulation of the right to use the homestead. The third part is mainly to analyze and study the causes of land transfer in the construction of new rural communities, through the study of the paper found. The reasons mainly focus on two aspects, first, the unreasonable design of our land legal system, and secondly, the government supervision and management. Part 4th is mainly based on the problems pointed out above. From the point of view of perfecting the legal system, these countermeasures mainly have the following five aspects, which are to establish the membership rights of rural villagers. The purpose is to define the ownership; Strengthen the transfer of land contractual management right, homestead use right and construction land use right; Strengthen rural land use planning, the implementation of village planning system. Our country should proceed from the national conditions, from the legal system for the rural land use release, increase the circulation of rural land, reduce the dependence of farmers on land.
