【摘要】：最高人民法院、最高人民檢察院、公安部、司法部于2003年7月頒布了《關(guān)于開展社區(qū)矯正試點(diǎn)工作的通知》規(guī)定:社區(qū)矯正是指將符合社區(qū)矯正條件的罪犯置于社區(qū)內(nèi),由專門的國家機(jī)關(guān),在相關(guān)社會(huì)團(tuán)體和民間組織以及社會(huì)志愿者的協(xié)助下,在判決或裁定規(guī)定的期限內(nèi),矯正其犯罪意識(shí)和行為惡習(xí),并促進(jìn)其順利回歸社會(huì)的非監(jiān)禁刑罰執(zhí)行活動(dòng)。筆者認(rèn)為社區(qū)矯正對(duì)象重新犯罪的原因主要可以分為主觀原因和客觀原因,主觀原因,又可叫做內(nèi)因,影響著社區(qū)矯正對(duì)象的思想,引起行為模式發(fā)生錯(cuò)誤,在社區(qū)矯正對(duì)象重新犯罪中起到主導(dǎo)作用;客觀原因,又可叫做外因,在社區(qū)矯正對(duì)象重新犯罪過程中起到催化作用。實(shí)踐證明,社區(qū)矯正對(duì)改造罪犯,促進(jìn)其回歸社會(huì)、預(yù)防犯罪起到一定的積極作用,但畢竟是在試點(diǎn)階段,各項(xiàng)法律法規(guī)及配套制度極不完善,實(shí)際操作中暴露了不少的問題,我們?cè)诜e極開展社區(qū)矯正試點(diǎn)的同時(shí),要清醒認(rèn)識(shí)到社區(qū)矯正在罪犯監(jiān)管力度上弱于監(jiān)禁刑,可能給社區(qū)帶來潛在的不安定因素,對(duì)社區(qū)矯正人員的重新犯罪的控制,在很大程度上影響著社區(qū)公眾對(duì)社區(qū)矯正制度的認(rèn)可和參與,決定著社區(qū)矯正工作的成敗。我們應(yīng)從修改法律制度出發(fā),完善社會(huì)管理,強(qiáng)化對(duì)社區(qū)服刑人員的教育和矯正,促進(jìn)服刑人員順利回歸社會(huì),提高社區(qū)服刑人員的改造質(zhì)量,預(yù)防和減少重新犯罪,達(dá)到社區(qū)矯正的最好的社會(huì)目標(biāo)。從我國開展社區(qū)矯正試點(diǎn)工作的現(xiàn)狀看,社區(qū)矯正在我國是有巨大的發(fā)展前景。但是,在實(shí)踐中,我們也看到,由于社區(qū)矯正試點(diǎn)工作先天不足,定性不準(zhǔn),在工作主體、對(duì)象和程序上缺乏法律的保障,在方法手段上缺乏完善的規(guī)定和管理,仍然存在重新犯罪的現(xiàn)象。社區(qū)矯正的全面推行,并達(dá)到減少和預(yù)防重新犯罪的目的,最終需要在立法方面給予完善和修改。
[Abstract]:The Supreme People's court, the Supreme People's Procuratorate, the Ministry of public security and the Ministry of Justice issued a notice on the implementation of the pilot work of community correction in July 2003: Community Correction refers to the placement of criminals in accordance with the conditions of community correction in the community, by the specialized state organs, with the assistance of the relevant social groups and civil organizations, as well as the social volunteers. The author believes that the reasons for the re crime of community correction objects can be divided into subjective and objective reasons, the subjective cause and the internal cause, which affect the community correction object. Thinking, causing a mistake in the behavior pattern, plays a leading role in the re crime of the community correction object; the objective reason can also be called the external cause, and plays a catalytic role in the process of the community corrections. The practice has proved that community correction plays a positive role in reforming criminals, promoting their return to society and preventing crime, but after all, it has a certain positive effect. It is in the pilot stage that various laws and regulations and supporting systems are very imperfect, and many problems have been exposed in actual operation. At the same time, we should actively carry out the pilot of community correction, and we should realize that the community correction is weaker than the imprisonment punishment in the criminal supervision, which may bring potential unsettled factors to the community and the weight of the community correctional personnel. The control of the new crime, to a great extent, affects the community public recognition and participation in the community correction system, and determines the success or failure of the community correction work. We should proceed from the revision of the legal system, improve the social management, strengthen the education and correction of the prisoners in the community, promote the service of the prisoners to return to the society smoothly, and improve the community serving prisoners. The improvement of quality, prevention and reduction of the new crime to achieve the best social goal of community correction. From the current situation of community correction pilot work in our country, community correction has a great development prospect in our country. However, in practice, we also see that because of the lack of community correction pilot work, qualitative inaccuracy, in the main body of work, The lack of legal guarantee in the image and procedure and the lack of perfect regulations and management in the method and means still exist in the phenomenon of re crime. The comprehensive implementation of the community correction and the goal of reducing and preventing the re crime need to be perfected and revised in the legislative aspect.
