【摘要】：未成年人代表著希望、代表著未來(lái),一個(gè)國(guó)家的希望和未來(lái)。但是,近年來(lái)未成年人犯罪率居高不下,逐漸成為一個(gè)國(guó)際性的社會(huì)問(wèn)題,世界各國(guó)也將未成年人犯罪作為維護(hù)社會(huì)穩(wěn)定的重要內(nèi)容。當(dāng)前,伴隨我國(guó)經(jīng)濟(jì)高速發(fā)展的同時(shí),各種思潮涌入國(guó)門(mén),導(dǎo)致社會(huì)環(huán)境空前復(fù)雜,不可遏制地催生了未成年人犯罪。未成年人犯罪幾成公害的今天,研究其犯罪成因及特點(diǎn),進(jìn)而制定完善有效的矯正措施,減少犯罪,引導(dǎo)未成年犯罪人走向正確的道路,對(duì)國(guó)家的發(fā)展和社會(huì)的穩(wěn)定具有重要意義。 本文擬從未成年人犯罪及矯正制度概念入手,闡述未成年人犯罪的特點(diǎn)及成因,進(jìn)而確定未成年人犯罪矯正制度構(gòu)設(shè)的立足點(diǎn)；通過(guò)對(duì)國(guó)外未成人犯罪矯正制度的介紹和評(píng)析,借鑒國(guó)外優(yōu)秀的立法理念和經(jīng)驗(yàn)；通過(guò)對(duì)我國(guó)未成年人犯罪矯正制度的歷史演進(jìn)、司法現(xiàn)狀及不足,對(duì)我國(guó)未成年人犯罪矯正制度進(jìn)行深層剖析與反思,進(jìn)而尋求我國(guó)未成年人犯罪矯正制度未來(lái)發(fā)展之路。 全文正文分為四個(gè)部分： 第一部分為“未成年人犯罪及矯正制度概述”,.著重從未成年人犯罪的概念入手,概括當(dāng)前未成年人犯罪的特點(diǎn),分析未成年人犯罪的成因,借以為未成年人犯罪矯正制度的確立提供基礎(chǔ)性的指導(dǎo)和方向；從對(duì)未成年人犯罪矯正制度的產(chǎn)生背景、歷史演進(jìn)及目前制度,對(duì)未成年人犯罪矯正制度做概括性的介紹。 第二部分為“國(guó)外未成年人犯罪矯正制度及其評(píng)析”,其中,就各國(guó)未成年人犯罪制度的發(fā)展歷程,總結(jié)先進(jìn)經(jīng)驗(yàn),對(duì)其發(fā)展趨勢(shì)作出科學(xué)的預(yù)測(cè)。 第三部分為“我國(guó)未成年人犯罪矯正制度及其存在的問(wèn)題”,通過(guò)追尋我國(guó)未成年人犯罪矯正的歷史發(fā)展的脈絡(luò),分析我國(guó)未成年人犯罪矯正制度現(xiàn)狀的成因及不足。 第四部分為“我國(guó)未成年人犯罪矯正制度之完善”,在對(duì)我 目前司法理念和立法制度反思的基礎(chǔ)上,提出對(duì)我國(guó)未成年人犯罪矯正制度的構(gòu)建與完善措施,為更加科學(xué)地確立完善的未成年司法制度貢獻(xiàn)綿薄之力。
[Abstract]:Minors represent hope, the future, the hope and future of a country. However, in recent years, juvenile crime rate has become an international social problem, and juvenile delinquency has been regarded as an important part of maintaining social stability. At present, with the rapid development of China's economy, various trends of thought pour into the country, resulting in an unprecedented complex social environment, unstoppable birth of juvenile delinquency. Today, when juvenile delinquency is almost becoming a public hazard, the causes and characteristics of juvenile delinquency are studied, and effective corrective measures are formulated to reduce crime and guide minor offenders to the correct path. It is of great significance to national development and social stability. This paper begins with the concept of juvenile delinquency and correction system, expounds the characteristics and causes of juvenile delinquency, and then determines the foothold of juvenile delinquency correction system. Through the historical evolution of juvenile delinquency correction system in our country, the judicial status quo and deficiencies, the author deeply analyzes and reflects on the juvenile delinquency correction system in our country. And then seek the future development of juvenile delinquency correction system in our country. The text is divided into four parts: the first part is an overview of juvenile delinquency and correction system. Focusing on the concept of juvenile delinquency, summarizes the characteristics of the current juvenile delinquency, analyzes the causes of juvenile delinquency, in order to provide basic guidance and direction for the establishment of juvenile delinquency correction system; From the background, historical evolution and current system of juvenile delinquency correction system, this paper makes a general introduction to juvenile delinquency correction system. The second part is "Foreign juvenile delinquency correction system and its analysis", in which, on the development of juvenile delinquency system in various countries, summed up the advanced experience, and made a scientific prediction of its development trend. The third part is "our country minor crime correction system and its existence question", through tracing our country minor crime correction historical development vein, analyzes our country minor crime correction system present situation causes and the insufficiency. The fourth part is the perfection of the juvenile delinquency correction system in our country. On the basis of the reflection of our current judicial concept and legislative system, the author puts forward the construction and consummation measures of the juvenile delinquency correction system in our country. For a more scientific establishment of a sound juvenile justice system contribution to a modest force.
