【摘要】：法律賦予公安機(jī)關(guān)許多特殊權(quán)力,公安隊(duì)伍始終處在應(yīng)對各種社會(huì)矛盾的第一線,稍有不慎就會(huì)釀成事端,處于輿論關(guān)注的焦點(diǎn),所以公安機(jī)關(guān)必須建立科學(xué)、嚴(yán)格、有效的監(jiān)督體制。1997年,公安部建立了警務(wù)督察制度,這對推動(dòng)整個(gè)公安機(jī)關(guān)和全體人民警察嚴(yán)格、公正、文明執(zhí)法起了不容忽視的作用。然而,隨著全面深化改革帶來的社會(huì)轉(zhuǎn)型、經(jīng)濟(jì)轉(zhuǎn)軌以及利益分配變化,使得整個(gè)社會(huì)的矛盾和沖突快速增長,這就給公安機(jī)關(guān)工作帶來了更為復(fù)雜嚴(yán)峻的執(zhí)法環(huán)境和形勢。為適應(yīng)這一變化,公安系統(tǒng)開始啟動(dòng)全面深化公安改革,旨在將其職責(zé)和效能更好的發(fā)揮出來,為新時(shí)期深化改革的全局提供一個(gè)安定團(tuán)結(jié)的社會(huì)環(huán)境。在這種形勢下,建立時(shí)間不長的警務(wù)督察制度就顯得不夠完善,不能完全適應(yīng)公安工作的需要。因此,警務(wù)督察制度必須要盡快完善,這樣才能更充分的強(qiáng)化其對各類警務(wù)活動(dòng)的監(jiān)督和制約作用,確保公安機(jī)關(guān)的工作符合人民群眾的期望,為全面深化公安改革目標(biāo)的達(dá)成提供保障。本文旨在探索如何完善警務(wù)督察制度。首先,介紹了警務(wù)督察制度的發(fā)展歷程和基本概念,以及其機(jī)構(gòu)、職權(quán)和監(jiān)督特點(diǎn),并分析了全面深化公安改革與完善警務(wù)督察制度的相關(guān)性。接著,根據(jù)X縣的警務(wù)督察工作情況,深刻剖析了警務(wù)督察制度存在的問題,如思想認(rèn)識有偏差、組織架構(gòu)不規(guī)范、職能權(quán)限不明確、人員素質(zhì)不整齊、法規(guī)制度不完善和責(zé)任追究缺力度等。然后,介紹美國、英國、法國、日本以及中國香港地區(qū)的警務(wù)監(jiān)督模式的主要特點(diǎn),并總結(jié)出監(jiān)督部門單一化、監(jiān)督權(quán)力法定化、監(jiān)督權(quán)威強(qiáng)效化、監(jiān)督程序科學(xué)化和監(jiān)督內(nèi)外結(jié)合化等五條具有共性的經(jīng)驗(yàn)做法。最后,文章提出如何在公安改革背景下進(jìn)一步完善我國警務(wù)督察制度的對策構(gòu)想,包括全面提高警務(wù)督察意識、合理配置警務(wù)督察職權(quán)、逐步健全督察法規(guī)制度、統(tǒng)一規(guī)范警務(wù)督察機(jī)構(gòu)、大力提升督察人員素質(zhì)、創(chuàng)新發(fā)展科學(xué)督察方式和切實(shí)加強(qiáng)責(zé)任追究力度。
[Abstract]:The law gives the public security organs many special powers, and the public security forces are always at the forefront of dealing with various social contradictions. A slight carelessness will lead to trouble and focus of public opinion. Therefore, the public security organs must establish a scientific and strict system. In 1997, the Ministry of Public Security established the police supervision system, which played an important role in pushing the whole public security organ and all the people's police to enforce the law strictly, impartially and civilly. However, with the social transformation, economic transition and benefit distribution changes brought by the comprehensive deepening of the reform, the contradictions and conflicts of the whole society grow rapidly, which brings a more complicated and severe law enforcement environment and situation to the work of the public security organs. In order to adapt to this change, the public security system started to deepen the public security reform in an all-round way in order to bring its duty and efficiency into full play, and to provide a stable and United social environment for deepening the reform in the new period. In this situation, the establishment of a police inspector system for a short period of time is not perfect enough to fully meet the needs of public security work. Therefore, the police supervision system must be perfected as soon as possible, so as to strengthen more fully its supervision and restriction on all kinds of police activities, and to ensure that the work of the public security organs meets the expectations of the people. To provide a guarantee for the realization of the goal of deepening the reform of public security in an all-round way. The purpose of this paper is to explore how to perfect the police supervision system. First of all, it introduces the development course and basic concept of the police supervision system, as well as its organization, authority and supervision characteristics, and analyzes the correlation between deepening the police security reform and perfecting the police supervision system. Then, according to the work situation of police inspector in X County, the problems existing in the police supervision system are deeply analyzed, such as the deviation of ideological understanding, the non-standard organizational structure, the unclear function and authority, and the irregular quality of the personnel. The laws and regulations system is imperfect and the responsibility investigation lacks the strength and so on. Then, it introduces the main characteristics of the police supervision mode in the United States, Britain, France, Japan and Hong Kong, China, and concludes that the supervision department is unitary, the supervision power is legalized, and the supervision authority is more effective. The scientific supervision procedure and the combination of internal and external supervision are five common practices. Finally, the article puts forward some countermeasures to perfect the police supervision system under the background of public security reform, including raising the police inspector's consciousness in an all-round way, rationally allocating the police inspector's powers and powers, and gradually perfecting the supervision law and regulations system. Unified and standardized police inspectors, vigorously improve the quality of inspectors, innovation and development of scientific supervision methods and strengthen accountability.
