【摘要】： 隨著計算機(jī)技術(shù)和現(xiàn)代通信技術(shù)的發(fā)展,信息網(wǎng)絡(luò)延伸至社會生活的各個角落,作為社會副產(chǎn)品的犯罪也隨之演變出多種新的犯罪表現(xiàn),刑事犯罪發(fā)生了深刻的變化。從國際警務(wù)改革的發(fā)展趨勢看,“情報信息主導(dǎo)警務(wù)”的理念已成為各國警務(wù)戰(zhàn)略的重點,我國各地公安機(jī)關(guān)根據(jù)各地特色提出了不同的警務(wù)戰(zhàn)略,其核心都是強(qiáng)調(diào)情報信息對警務(wù)工作的主導(dǎo),“以信息主導(dǎo)偵查”作為情報信息主導(dǎo)警務(wù)戰(zhàn)略的一部分也被引入了偵查機(jī)關(guān)的偵查破案中。然而,與實務(wù)界推行信息主導(dǎo)偵查工作機(jī)制的現(xiàn)狀相比,學(xué)術(shù)界對這一問題進(jìn)行系統(tǒng)研究的專著和文章都較少�；�于此,筆者以偵查信息論為題進(jìn)行了研究,從偵查信息的含義、偵查信息理論及再思考入手,研究了以下幾方面內(nèi)容。 第一章,從信息一詞的沿革和理解著手,為分析偵查信息的概念和特征作一鋪墊。在武漢教授以信息論為核心的偵查三論的基礎(chǔ)上,對偵查信息的含義及偵查信息理論進(jìn)行理論上的探討,并在當(dāng)前信息化的社會環(huán)境下對偵查三論提出筆者自己的新認(rèn)識,作為方法論引入刑事偵查領(lǐng)域的三論理論,應(yīng)站在刑事偵查學(xué)科目的的角度,著重完成偵查的任務(wù)。 第二章,在理論研究的基礎(chǔ)上,本文更多地關(guān)注偵查信息論如何更好地服務(wù)于偵查實踐。本章節(jié)圍繞“信息主導(dǎo)偵查”的主題,從信息主導(dǎo)偵查的必要性和可行性兩個方面分別展開論述。其中,從順應(yīng)社會生產(chǎn)力發(fā)展的必然趨勢、偵查工作本身的內(nèi)在要求、偵查任務(wù)完成的客觀需要三個角度論述了信息主導(dǎo)偵查的必要性;從偵查發(fā)展的“兩化”趨勢論述了信息主導(dǎo)偵查的可行性。 第三章,本章節(jié)專題研究信息的收集,即從偵查中的信息方法論角度展開論述。一是信息資源的發(fā)展變化。傳統(tǒng)工業(yè)社會環(huán)境中,由于犯罪行為和犯罪信息僅存在于現(xiàn)實空間,此時的偵查活動也只須存在于現(xiàn)實空間。在信息社會中,犯罪的觸角已延伸至虛擬的網(wǎng)絡(luò)空間,犯罪信息因此從三維的物理空間拓展到了一維的虛擬空間。二是信息的搜集。以未偵破案件信息、已偵破案件信息、虛擬空間信息分別闡述了信息搜集可采取的方法。 第四章,本章節(jié)專題研究信息的分析研判,即從偵查中的控制方法論角度展開論述。一是分析研判的內(nèi)容。分別從初級分析研判,又分信息可靠性和有效性的分析研判,高級分析研判,又分戰(zhàn)略情報信息分析研判、戰(zhàn)術(shù)情報信息分析研判、高危人群分析研判、串并案件分析研判逐一展開。二是信息分析研判的原理和方法,分別就總原理和總方法,以及基本原理與方法進(jìn)行了論述。 第五章,本章節(jié)專題研究信息主導(dǎo)偵查,即從偵查中的系統(tǒng)方法論角度展開論述。一是信息主導(dǎo)偵查的模式,以傳統(tǒng)的偵查模式和信息主導(dǎo)偵查的偵查模式分別作了闡述和對比論述。二是信息主導(dǎo)偵查的機(jī)制。信息主導(dǎo)偵查的構(gòu)成要素包含五個方面:意識、技術(shù)、機(jī)構(gòu)、人員、制度,筆者逐一進(jìn)行了闡述,并對信息主導(dǎo)偵查機(jī)制的具體實踐作了論述。
[Abstract]:With the development of computer technology and modern communication technology, information network extends to every corner of social life. As a social by-product crime, a variety of new crimes have been developed, and criminal crimes have undergone profound changes. From the trend of international police reform, the concept of "intelligence information leading police affairs" has become a concept. The key point of national police strategy is that public security organs of all parts of our country have put forward different policing strategies according to local characteristics. The core of which is to emphasize the guidance of information information to police work. "Information led investigation" as part of the strategy of intelligence information leading police affairs has also been introduced into the investigation cases of investigation organs. Compared with the current situation of implementing the mechanism of information led investigation, there are few treatises and articles on the systematic study of this problem in the academic circle. Based on this, the author took the investigation information theory as the topic, and studied the following aspects from the meaning of investigation information, the theory of investigation information and rethinking.
The first chapter, starting with the evolution and understanding of the word "information", makes a paving for the analysis of the concept and characteristics of investigation information. On the basis of the three theories of information theory as the core of the investigation in Wuhan, the author makes a theoretical discussion on the meaning of investigation information and the theory of investigation information, and puts forward a pen for investigation in the pre information social environment. His own new understanding, as the three theory of the introduction of methodology into criminal investigation, should focus on completing the task of investigation in the light of the purpose of criminal investigation.
In the second chapter, on the basis of theoretical research, this article pays more attention to the investigation information theory how to serve the investigation practice better. This chapter focuses on the theme of "information led investigation" and discusses the necessity and feasibility of the information led investigation respectively. Among them, the investigative workers are in conformity with the inevitable trend of the development of social productivity. The necessity of the information led investigation is discussed in three aspects: the inherent requirement of its own and the objective needs of the investigation task. The feasibility of the information led investigation is discussed from the "two" trend of the investigation and development.
The third chapter, the collection of information in this section, that is, from the perspective of information methodology in the investigation. One is the development and change of information resources. In the traditional industrial social environment, the criminal behavior and crime information only exist in the real space, and the investigation activities only exist in the real space. In the information society, the crime is committed. The contact angle has extended to the virtual network space, and the crime information has expanded from the three-dimensional physical space to the one dimensional virtual space. Two is the information collection. The case information has been detected without the detection of the case information, and the virtual space information explains the methods that the information collection can take.
The fourth chapter, the analysis of the research information in this chapter, that is, from the angle of the control methodology in the investigation. One is the analysis of the content of the study. The analysis and study of the reliability and effectiveness of the information are analyzed from the primary analysis, the advanced analysis, the strategic information analysis and the analysis of the information analysis, and the analysis and judgement of the tactical information information. The analysis of the high risk population, the analysis of the case and the case analysis is carried out one by one. Two is the principle and method of information analysis and judgment, and the general principle and the general method, as well as the basic principles and methods are discussed respectively.
The fifth chapter, the subject of this chapter studies information led investigation, that is, from the angle of systematic methodology in the investigation. First, the mode of information led investigation is expounded and contrasted with the traditional investigation mode and information led investigation mode. Two is the mechanism of information led investigation. The elements of information leading investigation It includes five aspects: consciousness, technology, organization, personnel, and system. The author elaborates one by one, and discusses the concrete practice of information led investigation mechanism.
