【摘要】:隨著刑罰執(zhí)行社會(huì)化的不斷發(fā)展,許多國家開始大量適用非監(jiān)禁刑。非監(jiān)禁刑相較于監(jiān)禁刑不但大大降低了行刑成本,更有利于教育和改造罪犯,將低再犯率。近年來,我國越來越重視對(duì)犯罪嫌疑人、被告人的人權(quán)保障,制定了以保障人權(quán)為基礎(chǔ)的暫予監(jiān)外執(zhí)行制度,以確保犯罪嫌疑人、被告人的基本權(quán)利。由于暫予監(jiān)外執(zhí)行制度變相減輕了刑罰,如果對(duì)這一制度使用不當(dāng)又缺乏有效監(jiān)督,就會(huì)極易導(dǎo)致執(zhí)法混亂,滋生腐敗,使本應(yīng)監(jiān)禁的犯罪分子利用非法手段逍遙法外。因此,如何通過立法手段對(duì)暫予監(jiān)外執(zhí)行及其法律監(jiān)督進(jìn)行規(guī)制,平衡暫予監(jiān)外執(zhí)行制度在打擊犯罪與保障人權(quán)價(jià)值上的沖突,建立適合我國國情的暫予監(jiān)外執(zhí)行法律監(jiān)督機(jī)制,從而實(shí)現(xiàn)我國設(shè)立暫予監(jiān)外執(zhí)行制度以保障罪犯人權(quán)的根本目的,是我國法治化進(jìn)程中必須解決的問題。本文從暫予監(jiān)外執(zhí)行的概念及其法律監(jiān)督的概念作為切入點(diǎn),在考察了我國關(guān)于暫予監(jiān)外執(zhí)行及其法律監(jiān)督的立法沿革和司法實(shí)踐的基礎(chǔ)上,結(jié)合我國刑事訴訟法的最新規(guī)定,分析現(xiàn)階段立法和司法上的不足之處,提出了從完善立法立法、建立檢察機(jī)關(guān)的同步監(jiān)督機(jī)制和利用社會(huì)力量監(jiān)督三個(gè)方面來構(gòu)建我國暫予監(jiān)外執(zhí)行法律監(jiān)督機(jī)制。全文分四章: 第一章概括論述了暫予監(jiān)外執(zhí)行及其法律監(jiān)督概念和價(jià)值。首先論證了暫予監(jiān)外執(zhí)行的概念以及暫予監(jiān)外執(zhí)行的基本特征;接著論述了法律監(jiān)督的內(nèi)涵和外延;最后分析了暫予監(jiān)外執(zhí)行法律監(jiān)督的價(jià)值。 第二章是對(duì)我國暫予監(jiān)外執(zhí)行法律監(jiān)督的立法與實(shí)踐考察。首先介紹了從新中國成立以來我國暫予監(jiān)外執(zhí)行制度及其法律監(jiān)督在立法上的相關(guān)規(guī)定,并指出我國現(xiàn)行法律規(guī)定,尤其是新修訂的刑事訴訟法的對(duì)其改進(jìn)以及依然存在的缺陷和漏洞;其次分析了我國暫予監(jiān)外執(zhí)行法律監(jiān)督在司法實(shí)踐中存在的問題,并分析我國暫予監(jiān)外執(zhí)行法律監(jiān)督制度不足的原因。 第三章闡述從立法上改革和完善我國暫予監(jiān)外執(zhí)行的法律監(jiān)督。首先從統(tǒng)一暫予監(jiān)外執(zhí)行的批準(zhǔn)機(jī)關(guān)出發(fā),然后論述如何完善暫予監(jiān)外執(zhí)行的批準(zhǔn)程序,最后闡述修改和完善社區(qū)矯正相關(guān)法律法規(guī),以確保有關(guān)機(jī)關(guān)從暫予監(jiān)外執(zhí)行的批準(zhǔn)到執(zhí)行都能進(jìn)行及時(shí)、全面的法律監(jiān)督。 第四章是論述如何構(gòu)建暫予監(jiān)外執(zhí)行的檢察監(jiān)督機(jī)制。重點(diǎn)論證如何改進(jìn)監(jiān)督手段,加強(qiáng)相關(guān)機(jī)構(gòu)間的聯(lián)動(dòng)機(jī)制以及完善責(zé)任追究機(jī)制,并適當(dāng)利用社會(huì)監(jiān)督的力量,構(gòu)建我國暫予監(jiān)外執(zhí)行的同步監(jiān)督機(jī)制。
[Abstract]:With the development of socialization of penalty execution, many countries begin to apply non-custodial punishment. Compared with the imprisonment penalty, the non-custodial penalty not only reduces the execution cost, but also helps to educate and reform the criminals and reduce the recidivism rate. In recent years, our country pays more and more attention to the human rights protection of criminal suspects and defendants, and has formulated a temporary execution system based on the protection of human rights to ensure the basic rights of criminal suspects and defendants. As the temporary system of execution out of prison reduces the penalty in disguise, if this system is not properly used and lacks effective supervision, it will easily lead to confusion of law enforcement, breed corruption and make criminals who should be imprisoned go unpunished by illegal means. Therefore, how to regulate the temporary outside execution and its legal supervision through legislative means, and balance the conflict between fighting crime and safeguarding the value of human rights. It is necessary to solve the problem in the process of rule of law in our country to establish a legal supervision mechanism suitable to the situation of our country and to realize the basic purpose of establishing a temporary execution system outside prison in order to protect the human rights of criminals in the course of our country's rule of law. Based on the concept of temporary execution outside prison and the concept of legal supervision as a starting point, this paper examines the legislative evolution and judicial practice of temporary execution outside prison and its legal supervision, and combines the latest provisions of our criminal procedure law. This paper analyzes the shortcomings of legislation and judicature at the present stage, and puts forward the following three aspects: perfecting legislation, establishing synchronous supervision mechanism of procuratorial organs and utilizing social power to construct legal supervision mechanism of temporary execution outside prison in our country. The thesis is divided into four chapters: the first chapter discusses the concept and value of temporary execution and legal supervision. At first, it demonstrates the concept of temporary execution outside prison and the basic characteristics of temporary execution outside prison; then discusses the connotation and extension of legal supervision; finally, analyzes the value of legal supervision outside temporary supervision. The second chapter is about the legislation and practice of the temporary execution of legal supervision in China. First of all, it introduces the enforcement system of temporary imprisonment outside prison since the founding of the people's Republic of China and the relevant legislative provisions of its legal supervision, and points out the current legal provisions of our country. Especially the improvement of the newly revised Criminal procedure Law and the defects and loopholes that still exist. Secondly, it analyzes the problems existing in the judicial practice of the legal supervision of temporary execution outside the prison in our country. And analyzes our country temporarily outside the prison execution legal supervision system insufficient reason. Chapter three expounds the legislative reform and perfection of the legal supervision of temporary execution outside the prison in our country. First of all, starting from the unified approval authority for temporary execution outside prison, then discussing how to improve the approval procedure for temporary execution outside the prison, and finally expounding the revision and improvement of the laws and regulations related to community correction. To ensure timely and comprehensive legal supervision from approval to execution outside the prison. The fourth chapter discusses how to construct the procuratorial supervision mechanism. The emphasis is on how to improve the means of supervision, strengthen the linkage mechanism between relevant institutions and perfect the accountability mechanism, and make proper use of the social supervision power to construct the synchronous supervision mechanism for the temporary execution outside the prison in our country.
