【摘要】：民眾對(duì)非物質(zhì)文化遺產(chǎn)的認(rèn)識(shí)越來越深入,但是概念及若干專業(yè)問題還有待厘清。非物質(zhì)文化遺產(chǎn)沒有"緩沖區(qū)",不具"唯一性"而具"游移性",非物質(zhì)文化遺產(chǎn)中"文化空間"與作為非物質(zhì)文化遺產(chǎn)組成部分的"一般場所"是不相同的概念,遺產(chǎn)的評(píng)定不受"生源地"所限。保護(hù)"非物質(zhì)文化遺產(chǎn)"的規(guī)范性文件中使用"代表性"或"代表作"有其立法用意,非物質(zhì)文化遺產(chǎn)法與知識(shí)產(chǎn)權(quán)法保護(hù)的客體(對(duì)象)既有相同點(diǎn)也存在區(qū)別,而"非物質(zhì)文化遺產(chǎn)"與"非物質(zhì)文化遺產(chǎn)產(chǎn)品"也是完全不一樣的概念。
[Abstract]:People's understanding of intangible cultural heritage is getting deeper and deeper, but the concept and some professional problems need to be clarified. Intangible cultural heritage has no "buffer zone" and is not "unique" but "wandering". The concept of "cultural space" in intangible cultural heritage is different from that of "general place" as an integral part of intangible cultural heritage. The assessment of the estate is not limited by the "place of origin". The use of "representative" or "representative" in normative documents for the protection of "intangible cultural heritage" has its legislative intent, and there are similarities and differences between the objects (objects) protected by the law of intangible cultural heritage and the law of intellectual property rights. And intangible cultural heritage products are completely different concepts.
