【摘要】： 戶(hù)籍制度是國(guó)家行政管理的一項(xiàng)基本制度。中國(guó)現(xiàn)行戶(hù)籍制度已實(shí)施了半個(gè)多世紀(jì),近年來(lái)伴隨著中國(guó)社會(huì)快速發(fā)展、進(jìn)步,這項(xiàng)制度對(duì)公眾權(quán)益造成的侵害日趨明顯,戶(hù)籍制度的改革已成為當(dāng)今中國(guó)社會(huì)改革內(nèi)容的重要組成部分。由于牽扯十多億人口的切身利益,改革的成敗必將影響到整個(gè)社會(huì)的和諧發(fā)展,是一個(gè)應(yīng)該重點(diǎn)研究的問(wèn)題。 本文從現(xiàn)行戶(hù)籍制度制約公眾權(quán)益的表現(xiàn)形式出發(fā),分析了現(xiàn)行戶(hù)籍制度對(duì)公眾權(quán)益造成侵害的原因在于戶(hù)籍的二元性質(zhì),并從行政管理和政府公共政策選擇的相關(guān)理論出發(fā),研究了這場(chǎng)改革中政府行政協(xié)調(diào)的地位和作用以及擔(dān)當(dāng)?shù)穆毮?探討了政府通過(guò)行政協(xié)調(diào)的手段保證戶(hù)籍改革中的公眾權(quán)益,以最終實(shí)現(xiàn)戶(hù)籍制度的一元制,體現(xiàn)社會(huì)公正、公平的行政目標(biāo)。 現(xiàn)階段,戶(hù)籍制度的改革進(jìn)程緩慢,嚴(yán)密的行政管理體系以及附加在戶(hù)籍之上的福利待遇等各種因素,使戶(hù)籍改革一時(shí)堅(jiān)冰難破。以社會(huì)穩(wěn)定為前提的戶(hù)籍改革必然是一個(gè)較為漫長(zhǎng)且艱巨的過(guò)程,漸進(jìn)決策模式的采用更符合中國(guó)國(guó)情,而且政府在公共政策的選擇及行政作為、行政能力、執(zhí)政理念、發(fā)展職能等方面,必然在戶(hù)籍改革中接受考驗(yàn)并起到至關(guān)重要的作用。
[Abstract]:Household registration system is a basic system of national administration. The current household registration system in China has been implemented for more than half a century. In recent years, with the rapid development and progress of Chinese society, the infringement on public rights and interests caused by this system has become increasingly obvious. The reform of household registration system has become an important part of China's social reform. Due to the vital interests of more than one billion people, the success or failure of the reform will affect the harmonious development of the whole society. Starting from the form of the current household registration system which restricts the public rights and interests, this paper analyzes that the reason why the current household registration system infringes on the public rights and interests lies in the dual nature of the household registration system, and proceeds from the relevant theories of the administration and the choice of the government's public policy. This paper studies the position, function and function of government administrative coordination in this reform, and probes into the public rights and interests of the government in the reform of household registration through the means of administrative coordination, so as to realize the monistic system of the household registration system and embody social justice. Fair administrative objectives At present, the reform process of the household registration system is slow, the strict administrative system and the welfare treatment attached to the household registration system make the reform of household registration hard to break for a while. The reform of household registration based on the premise of social stability must be a long and arduous process. The adoption of progressive decision-making mode is more in line with the national conditions of China, and the government's choice of public policy and administrative action, administrative ability, governing concept, The development function and so on must accept the test and play the vital role in the household registration reform.
