【摘要】：英國社會(huì)法學(xué)派代表斯賓塞認(rèn)為:"社會(huì)因素是誘發(fā)犯罪的原因,將罪犯置于社會(huì)進(jìn)行監(jiān)管,在社會(huì)內(nèi)部化解罪惡,可節(jié)省執(zhí)法資源,減少再犯罪可能。"1950年后,社區(qū)矯正在罪犯社會(huì)化思潮推動(dòng)下由孕育轉(zhuǎn)入各國實(shí)踐。我國社區(qū)矯正適用較晚,經(jīng)歷了一段實(shí)踐過程,于2011年通過的《刑法修正案(八)》正式確立社區(qū)矯正制度,其規(guī)定"對(duì)宣判管制、緩刑、假釋及被剝奪政治權(quán)利在社會(huì)服刑的犯罪人依法實(shí)行社區(qū)矯正"。但《刑法修正案(八)》對(duì)于社區(qū)矯正的執(zhí)行主體未做明確規(guī)定,對(duì)此一直存在爭議,理論上主要有三種觀點(diǎn):由公安機(jī)關(guān)執(zhí)行、由司法行政部門執(zhí)行或設(shè)立全新機(jī)構(gòu)執(zhí)行。然而依據(jù)行刑權(quán)統(tǒng)一性觀點(diǎn),多數(shù)學(xué)者贊同由司法行政部門執(zhí)行。除上述執(zhí)行主體爭議外,我國社區(qū)矯正制度還存在著管理方法滯后、社區(qū)基礎(chǔ)不成熟、專業(yè)力量不足等問題。因此,通過對(duì)社區(qū)矯正理論與實(shí)踐問題的研究,在我國建立風(fēng)險(xiǎn)管理模式、合理化管理體系、高科技管理手段等社區(qū)矯正監(jiān)管方式,可進(jìn)一步深化與完善我國社區(qū)矯正制度,更好地幫助罪犯社會(huì)化改造,預(yù)防再犯罪,實(shí)現(xiàn)法治國家、和諧社會(huì)的夢(mèng)想。
[Abstract]:Spencer, a representative of the British School of Social Law, said: "Social factors are the cause of crime. Putting criminals under the supervision of society and defusing evil within society can save law enforcement resources and reduce the possibility of reoffending." after 1950, Community correction is promoted by the socialization of criminals from gestation to national practice. Our country community correction is applied late, has experienced a period of practice process, the "Criminal Law Amendment (8)" adopted in 2011 formally establishes the community correction system, its stipulation "to sentence the sentence control, the suspended sentence," Offenders who are paroled and deprived of their political rights in the society shall carry out community correction in accordance with the law. " However, the Criminal Law Amendment (8) does not clearly stipulate the subject of community correction, which has always been controversial. In theory, there are three main viewpoints: execution by public security organs, execution by judicial administrative departments or establishment of new institutions. However, according to the unity of execution power, most scholars agree that execution should be carried out by judicial administrative department. In addition to the above disputes, there are still some problems in our community correction system, such as lagging management methods, immature community foundation and insufficient professional strength. Therefore, through the study of the theory and practice of community correction, the establishment of risk management model, rational management system, high-tech management means and other ways of community correction supervision in China, can further deepen and improve our community correction system. Better help criminals socialize reform, prevent crime, realize the dream of a country ruled by law and harmonious society.
