我國(guó)戶籍制度改革的法學(xué)思考

【摘要】:我國(guó)現(xiàn)行的戶籍管理制度是以戶口登記與戶口審批作為前提,將我國(guó)人口分為農(nóng)業(yè)家庭戶和非農(nóng)業(yè)家庭戶的二元戶籍管理制度。由于人們戶口性質(zhì)的不同在社會(huì)生活中所享受的政策也就不同,例如子女受教育、勞動(dòng)就業(yè)、社會(huì)保障、醫(yī)療保險(xiǎn)以及上大學(xué)錄取分?jǐn)?shù)線等等,通過(guò)戶口審批在農(nóng)業(yè)戶口與非農(nóng)業(yè)戶口相互轉(zhuǎn)換方面嚴(yán)格受到了限制,嚴(yán)重影響了憲法確認(rèn)的平等權(quán)和自由權(quán)的實(shí)現(xiàn)。在經(jīng)濟(jì)社會(huì)日益發(fā)展的今天,現(xiàn)行的戶籍管理制度不足暴露的越來(lái)越明顯,嚴(yán)重限制了農(nóng)村人口向城市流動(dòng),小城市人口向大城市、特大城市方向流動(dòng),限制了我國(guó)城市化的發(fā)展。 作為特定歷史的產(chǎn)物,城鄉(xiāng)有別的二元戶籍管理制度在計(jì)劃經(jīng)濟(jì)條件下有其存在的必然,曾經(jīng)為我國(guó)的現(xiàn)代化建設(shè)做出了巨大的貢獻(xiàn)。但是,改革開放后,這一制度越來(lái)越多的不適應(yīng)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的發(fā)展,甚至成為了經(jīng)濟(jì)發(fā)展的障礙。國(guó)家和省、市各級(jí)人民政府認(rèn)識(shí)到二元戶籍制度的不足之處并逐漸開始重視,積極的推行一些便民利民的措施,來(lái)縮短現(xiàn)行戶籍制度帶來(lái)的差距,同時(shí)學(xué)術(shù)界也對(duì)戶籍制度進(jìn)行反思。當(dāng)前,理論和實(shí)務(wù)界都在呼吁改革現(xiàn)行戶籍制度,紛紛建言獻(xiàn)策,在這一背景下,筆者試圖以法學(xué)的視角,借鑒其他領(lǐng)域的研究成果,對(duì)我國(guó)戶籍制度改革在歷史溯源,現(xiàn)狀考察,橫向借鑒的基礎(chǔ)上提出自己的方案設(shè)想。
[Abstract]:The current household registration management system in our country is based on household registration and household registration examination and approval. The population of our country is divided into agricultural households and non-agricultural households. Because of the difference in the nature of the hukou, the policies enjoyed by people in social life are different, such as the education of their children, employment, social security, medical insurance, and the graduation line for admission to university, and so on. The conversion between agricultural and non-agricultural hukou is strictly restricted through the approval of hukou, which seriously affects the realization of equality and liberty recognized by the Constitution. With the increasing economic and social development, the current household registration management system is becoming more and more obvious, seriously restricting the flow of rural people to cities, and from small cities to large cities and mega-cities. It limits the development of urbanization in China. As a product of special history, there are other dual household registration management systems in urban and rural areas, which are inevitable under the planned economy, and have made great contributions to the modernization of our country. However, after reform and opening up, this system is more and more unsuitable for the development of socialist market economy, and even becomes an obstacle to economic development. The state, provincial and municipal people's governments at all levels have realized the deficiencies of the dual household registration system and have gradually begun to attach importance to it. They have actively implemented some measures that are convenient to the people and benefit the people, in order to shorten the gap brought about by the current household registration system. At the same time, academia also reflects on the household registration system. At present, both theoretical and practical circles are calling for the reform of the current household registration system. Under this background, the author tries to trace back to the history of the reform of the household registration system in our country from the perspective of law and the research results of other fields. On the basis of investigation of the present situation, the author puts forward his own plan based on the horizontal reference.
