【摘要】：涉農(nóng)職務(wù)犯罪主要是指在涉及到農(nóng)村生產(chǎn)建設(shè)、經(jīng)濟(jì)發(fā)展過程中,所產(chǎn)生的國家工作人員或者受國家委托從事公務(wù)活動的非國家工作人員利用職權(quán),實(shí)施的應(yīng)當(dāng)受到刑法處罰的職務(wù)犯罪行為�，F(xiàn)階段涉農(nóng)職務(wù)犯罪主要出現(xiàn)在農(nóng)村基礎(chǔ)設(shè)施建設(shè)和拆遷改造、農(nóng)村土地征用開發(fā)、支農(nóng)惠農(nóng)資金管理、農(nóng)村教育和醫(yī)療衛(wèi)生、農(nóng)村綜合改革,以及農(nóng)村基層政權(quán)和自治組織建設(shè)等領(lǐng)域和環(huán)節(jié)中。 近年來,隨著蕪湖市三山區(qū)的發(fā)展,各類涉農(nóng)職務(wù)犯罪層出不窮,已經(jīng)成為一個(gè)視關(guān)三山區(qū)社會主義新農(nóng)村建設(shè)以及農(nóng)村穩(wěn)定和發(fā)展的一個(gè)不容忽視的重大問題。在看到三山區(qū)成立后發(fā)生在農(nóng)村建設(shè)和發(fā)展過程中的各類涉農(nóng)職務(wù)犯罪,我深感責(zé)任重大,所以在辦理各類涉農(nóng)職務(wù)犯罪案件過程中,我們更應(yīng)該看到隱藏在這些涉農(nóng)職務(wù)犯罪案件背后的一些問題,在加大力度查辦涉農(nóng)職務(wù)犯罪案件的基礎(chǔ)上,更多的做好預(yù)防工作,達(dá)到標(biāo)本兼治的目的。 本文共分三個(gè)部分,內(nèi)容如下： 第一部分介紹了蕪湖市三山區(qū)檢察院近年來查辦的涉農(nóng)職務(wù)犯罪的基本情況,并對三山區(qū)涉農(nóng)職務(wù)犯罪的現(xiàn)狀、作案手段以及犯罪特點(diǎn)進(jìn)行了分析。 第二部分著重從涉農(nóng)職務(wù)犯罪的主體、客體、主觀方面、客觀方面四個(gè)方面對涉農(nóng)職務(wù)犯罪的構(gòu)成進(jìn)行了闡述,并對涉農(nóng)職務(wù)犯罪的成因和社會危害性進(jìn)行了分析。 第三部分從我國現(xiàn)階段對涉農(nóng)職務(wù)犯罪的一些做法以及國外一些先進(jìn)的做法進(jìn)行了分析說明,最后提出了一些自己對涉農(nóng)職務(wù)犯罪預(yù)防的想法和建議。 通過以上論述,筆者得出以下結(jié)論,只要加大對涉農(nóng)職務(wù)犯罪的打擊力度,同時(shí)做好涉農(nóng)職務(wù)犯罪的預(yù)防,才能做到標(biāo)本兼治,才能更好的維護(hù)農(nóng)村經(jīng)濟(jì)建設(shè)的發(fā)展,從而達(dá)到建設(shè)社會主義新農(nóng)村的宏偉目標(biāo)。
[Abstract]:Agricultural job-related crimes mainly refer to the use of power by state functionaries or non-State functionaries entrusted by the State to engage in official activities in the course of rural production and economic development. An act of duty crime that should be punished by criminal law. At this stage, job-related crimes related to agriculture mainly occur in the construction of rural infrastructure and demolition and transformation, the acquisition and development of rural land, the management of funds to support agriculture and benefit agriculture, rural education and health care, and the comprehensive reform of rural areas. As well as the rural grass-roots political power and self-governing organization construction and other fields and links. In recent years, with the development of Sanshan District of Wuhu City, various kinds of crimes involving agriculture and official duties have emerged in endlessly, which has become a major problem that can not be ignored in the construction of new socialist countryside and the stability and development of rural areas in Sanshan District of Wuhu City. I am deeply responsible for all kinds of agriculture-related job-related crimes that have occurred in the course of rural construction and development since the founding of Sanshan District, so in the course of handling all kinds of agriculture-related job-related crimes, We should also see some problems hidden behind these crimes involving agriculture. On the basis of strengthening the investigation and handling of cases involving agricultural duty crimes, we should do more preventive work to achieve the goal of treating both symptoms and symptoms. This paper is divided into three parts: the first part introduces the basic situation of the agricultural duty crime investigated by the Sanshan District Procuratorate in Wuhu City in recent years, and the present situation of the agricultural duty crime in the three mountain areas. The crime means and the characteristics of the crime were analyzed. The second part focuses on the main body, object, subjective and objective aspects of the agriculture-related duty crime, and analyzes the causes and social harmfulness of the agriculture-related duty crime. In the third part, the author analyzes and explains some methods of agricultural duty crime and some advanced methods in foreign countries at the present stage in our country, and finally puts forward some ideas and suggestions on the prevention of agricultural duty crime. Through the above discussion, the author draws the following conclusions, as long as we increase the crackdown on the crimes committed by agricultural officials, and do a good job of preventing the crimes, we can do both the root and the root of the crime, and better safeguard the development of rural economic construction. In order to achieve the goal of building a new socialist countryside.
