【摘要】：社區(qū)矯正制度在我國(guó)的確立是我國(guó)刑罰執(zhí)行方式的改革與創(chuàng)新。社區(qū)矯正人員是社區(qū)矯正的核心元素，對(duì)其進(jìn)行實(shí)證研究，，可以客觀地反映出我國(guó)社區(qū)矯正制度的實(shí)施情況。在充分調(diào)研的基礎(chǔ)上，對(duì)我國(guó)社區(qū)矯正人員進(jìn)行定量分析與定性分析，發(fā)現(xiàn)一些特征，具體表現(xiàn)在：我國(guó)社區(qū)矯正人員人數(shù)多，重新犯罪率低，矯正類型以緩刑居多；罪名分布廣泛，以妨害社會(huì)管理秩序罪最多，需要對(duì)其進(jìn)行分類管理。此外，一方面，我國(guó)社區(qū)矯正人員經(jīng)教育改造、幫困扶助，在思想上有較大改觀，消除了其過多的心理障礙，生活上享有基本的保障，同時(shí)，與監(jiān)禁罪犯相比，我國(guó)社區(qū)矯正人員享有較大的人身自由，人權(quán)保障明顯增強(qiáng)；另一方面，我國(guó)社區(qū)矯正人員經(jīng)偵查、起訴、審判程序已經(jīng)切身感受到刑法的威懾力，對(duì)符合條件的社區(qū)矯正人員實(shí)行社區(qū)矯正不失刑罰的嚴(yán)厲性，因此，從特殊預(yù)防的角度來說，實(shí)行社區(qū)矯正對(duì)社區(qū)矯正人員已經(jīng)起到了預(yù)防其重新犯罪的作用。當(dāng)被質(zhì)疑實(shí)行社區(qū)矯正降低了刑罰的懲罰性，減小了一般預(yù)防的作用，社區(qū)矯正人員的各種思想、行為狀態(tài)給出了一個(gè)否定的回應(yīng)�？偟膩碚f，社區(qū)矯正兼顧了預(yù)防犯罪與保障人權(quán)兩方面任務(wù)，與監(jiān)禁矯正相比，具有一定的優(yōu)越性，我國(guó)應(yīng)當(dāng)繼續(xù)推行這一制度，并不斷完善社區(qū)矯正法律法規(guī)等規(guī)范性文件，以在新時(shí)期取得新突破。
[Abstract]:The establishment of community correction system in our country is the reform and innovation of penalty execution in our country. Community correction personnel are the core elements of community correction. An empirical study on them can objectively reflect the implementation of community correction system in China. On the basis of full investigation, quantitative analysis and qualitative analysis of community correction personnel in our country, found some characteristics: the number of community correction personnel in our country is large, the crime rate is low again, and the type of correction is probation; The crime is widely distributed, and the crime of disturbing the social management order is the most, which needs to be managed by classification. In addition, on the one hand, through education and reform, community correctors in our country have greatly improved their thinking, eliminated their excessive psychological barriers, and enjoyed basic protection in their daily lives. At the same time, compared with the imprisonment of criminals, Our community correction personnel enjoy greater personal freedom, and the protection of human rights is obviously enhanced. On the other hand, through investigation, prosecution, and trial procedures, our community correction personnel have already felt the deterrent force of the criminal law. Community correction for qualified community correction personnel does not lose the severity of punishment, therefore, from the perspective of special prevention, community correction has played a role in preventing community correction personnel from reoffending. When it is questioned that community correction reduces the penalty of punishment and reduces the role of general prevention, community correction personnel give a negative response to all kinds of thoughts and behavior state. In general, community correction takes both crime prevention and protection of human rights into account, and it has some advantages over corrections in imprisonment. Our country should continue to implement this system and constantly improve normative documents such as community correction laws and regulations. In order to make a new breakthrough in the new era.
