未成年人不良行為與犯罪預防策略研究

【摘要】:預防未成年人犯罪是犯罪預防的重要組成部分,在當今未成年人犯罪率居高不下的情況下,筆者從中等職業(yè)學校學生這個特殊的群體入手,研究了這個未成年人群體的不良行為并提出了犯罪預防策略。 本論文由導言、三章和結(jié)語組成。 導言部分從James Q .Wilson的一句話開篇,指出了從犯罪源頭進行犯罪預防控制的重要性。因為任何事物都是一個從量變到質(zhì)變的過程,不良行為積累達到一定程度,必然會發(fā)生質(zhì)變,變成犯罪行為。 第一章主要探討了什么是不良行為以及通過社會調(diào)查的方法研究了中等職業(yè)學校學生不良行為的現(xiàn)狀并得出結(jié)論,闡明了本論文研究的重要性。首先對不良行為的概念作了界定;其次通過社會調(diào)查的方法對中等職業(yè)學校學生不良行為和法律意識的情況作了詳細的調(diào)查和統(tǒng)計分析,最后得出結(jié)論:中等職業(yè)學校未成年人學生的不良行為具有普遍性和嚴重性,大量的不良行為處于違法和輕微犯罪的邊緣,并存在進一步惡化的可能,需要我們高度重視并積極采取應對策略。 第二章闡述了造成中等職業(yè)學校學生不良行為泛濫的原因:主要是由于防范方面存在一系列問題所致。筆者根據(jù)社會調(diào)查的結(jié)果發(fā)現(xiàn)在預防未成年人不良行為方面存在的主要問題是:1、防范機制的缺位;2、法治觀念缺位;3、《預防未成年人犯罪法》的缺位。未成年人的不良行為得不到及時有效的教育和矯治,將會產(chǎn)生嚴重的后果。 第三章針對調(diào)查研究中發(fā)現(xiàn)的問題,并在結(jié)合國外的理論和實踐的基礎(chǔ)上提出了預防中等職業(yè)學校學生違法犯罪的策略。這些策略包括:1、建立有效的不良行為防范機制;2、強化法制教育的地位;3、建立《預防未成年人犯罪法》的執(zhí)行機構(gòu);4、提高學生抵御不良行為誘惑的能力;5、建立校園執(zhí)法機構(gòu),實現(xiàn)《預防未成年人犯罪法》和《校園安全法》的對接。 結(jié)語指出我國在預防未成年人犯罪方面的研究還處于起步階段,預防未成年人犯罪問題是一個系統(tǒng)工程,需要各方面積極參與,并特別強調(diào)了對未成年人進行法制教育的重要性。最后指出構(gòu)建社會主義和諧社會,為我們預防未成年人犯罪帶來了新的理念和新的認識。
[Abstract]:The prevention of juvenile delinquency is an important part of crime prevention. With the high crime rate of minors today, the author starts with the special group of secondary vocational school students. This paper studies the bad behavior of this group of minors and puts forward the crime prevention strategy. This thesis consists of introduction, three chapters and conclusion. The introduction begins with a sentence by James Q. Wilson, which points out the importance of crime prevention and control from the source of crime, because everything is a process from quantitative to qualitative change, and bad behavior accumulates to a certain extent. There is bound to be a qualitative change and a criminal act. The first chapter mainly discusses what is bad behavior and studies the current situation of secondary vocational school students' bad behavior through the method of social investigation and draws a conclusion. This paper expounds the importance of the research in this paper. Firstly, it defines the concept of bad behavior; secondly, it makes a detailed investigation and statistical analysis on the situation of students' bad behavior and legal consciousness in secondary vocational schools through the method of social investigation. Finally, it is concluded that the bad behavior of minor students in secondary vocational schools is universal and serious, and a large number of bad behaviors are on the verge of breaking the law and committing minor crimes, and there is a possibility of further deterioration. We need to attach great importance to and actively adopt coping strategies. The second chapter expounds the causes of the spread of bad behavior among students in secondary vocational schools: it is mainly caused by a series of problems in prevention. According to the results of social investigation, the author finds out that the prevention of bad behavior of minors is based on the results of social investigation. The main problems in this respect are: 1, the absence of a preventive mechanism, the absence of the concept of the rule of law, and the absence of the Law on the Prevention of Juvenile Delinquency. There will be serious consequences. The third chapter focuses on the problems found in the investigation. On the basis of combining the theory and practice of foreign countries, this paper puts forward the strategies of preventing students from breaking the law and committing crimes in secondary vocational schools. These strategies include: 1, establishing an effective prevention mechanism of bad behavior, strengthening the status of legal education, and establishing. The enforcement agency of the Law on the Prevention of Juvenile Delinquency is to improve students' ability to resist the temptation of bad behavior and to set up a campus law enforcement agency. Realize the docking between the Prevention of Juvenile Delinquency Law and the Campus Safety Law. The conclusion points out that the research on the prevention of juvenile delinquency in China is still in its infancy, and that the prevention of juvenile delinquency is a systematic project and requires the active participation of all parties. Finally, it points out that the construction of a harmonious socialist society has brought us new ideas and new understanding for the prevention of juvenile delinquency.
