論危險接受的處理模式

【摘要】：現(xiàn)有的危險接受處理模式均無法邏輯圓滿地處理危險接受的問題。處理危險接受,應當依據(jù)"二階層式處理模型",將行為人對危害結果的支配作為歸責的積極性、前提性條件,將被害人對利益不存在有效的自我決定作為對行為人進行歸責的消極性、后置性條件。根據(jù)行為人對危險結果是否有支配,危險接受可以被分為"自己危險化的參與"與"基于合意的他者危險化"兩種類型。在"自己危險化的參與"的情況下,行為人對危險結果無支配,行為人不負刑事責任。在"基于合意的他者危險化"的情況下,若涉及的是生命以及關乎自由意志延續(xù)的身體利益之外的利益,行為人行為的構成要件符合性被阻卻。否則,不能排除對行為人的歸責,但應當在量刑時從寬處罰。
[Abstract]:None of the existing risk acceptance treatment modes can logically and successfully deal with the problem of risk acceptance. In order to deal with risk acceptance, according to the "two-level treatment model", the actor's dominance of the harm result should be regarded as the enthusiasm of imputation, the prerequisite condition, and the victim's non-effective self-decision on the benefit as the negative and post-condition of imputation to the actor. According to whether the actor has control over the result of the risk, the acceptance of risk can be divided into two types: "the participation of one's own danger" based on the desired danger of the other. In the case of "the participation of one's own danger", the actor has no control over the dangerous result, and the actor is not responsible for the crime. In the case of "danger of the other based on agreement", if it involves life and interests other than the continuation of free will, the conformity of the constituent elements of the behavior of the actor is hindered. Otherwise, the imputation of the perpetrator cannot be ruled out, but the punishment should be lenient at the time of sentencing.
