【摘要】：1997年新刑法將非法行醫(yī)行為犯罪化，由于法條僅作簡單敘明，，本罪的主體、“情節(jié)嚴重”等語義不確定，使得在將非法行醫(yī)行為犯罪化的過程中，具體行為在罪與非罪的界限不斷模糊、變化，導(dǎo)致理論和實踐中對本罪的相關(guān)問題存在著較多的爭議。針對這些問題進行研究，具有重要的理論和實踐意義。 本文通過介紹我國及國外非法行醫(yī)罪立法概況，指出社會轉(zhuǎn)型期將非行醫(yī)行為犯罪化必要性，同時強調(diào)刑法介入非法行醫(yī)應(yīng)保持適度。然后分析非法行醫(yī)罪的性質(zhì)與特征，根據(jù)非法行醫(yī)罪是法定犯、情節(jié)犯、結(jié)果加重犯、抽象危險犯，尋找非法行醫(yī)罪的理論定位，為后面分析非法行醫(yī)的犯罪構(gòu)成、認定與完善作鋪墊。 在分析犯罪構(gòu)成與罪的認定時，緊緊圍繞非法行醫(yī)罪的理論定位，運用犯罪化與非犯罪化理論對非法行醫(yī)罪進行解讀，堅持非法行醫(yī)行為犯罪化的必要性和適度性的平衡，強調(diào)在理論上探討認定非法行醫(yī)罪的主體、“情節(jié)嚴重”、罪與非罪、此罪與彼罪時，應(yīng)遵循刑法的謙抑性、最低限度干預(yù)原則、補充性原則、嚴格區(qū)分刑事制裁、民事制裁、行政制裁的原則、法益兼顧原則，充分實現(xiàn)對犯罪化的制約作用。對于非法行醫(yī)罪的排除犯罪事由，本文論述了被害人承諾不能成為非法行醫(yī)罪違法性阻卻事由，無期待可能性可作為非法行醫(yī)罪的排除犯罪事由。 本文始終貫穿著拋棄以刑法為主要法律手段的“刑法萬能”觀念，堅持對刑法相關(guān)原則的貫徹，以期更好地體現(xiàn)現(xiàn)代刑法精神，更好地符合非法行醫(yī)罪
[Abstract]:In 1997, the new criminal law criminalized illegal medical practice. Because the provisions of the law are simply stated, the subject of the crime and the meaning of "serious circumstances" are uncertain, so that in the process of criminalizing the illegal practice of medicine, The boundary between crime and non-crime has been blurred and changed, which leads to more controversy about the crime in theory and practice. It is of great theoretical and practical significance to study these problems. By introducing the legislation of illegal medical practice in China and abroad, this paper points out the necessity of criminalizing non-medical practice in the period of social transformation, and emphasizes that the criminal law intervention in illegal practice of medicine should be kept in moderation. Then it analyzes the nature and characteristics of the crime of illegal practice of medicine. According to the fact that the crime of illegal practice of medicine is a legal offence, a circumstance crime, an aggravating result offence, an abstract dangerous crime, and the theoretical orientation of the crime of illegal practice of medicine is sought, the composition of the crime of illegal practice of medicine is analyzed later. Identify and perfect as a paver. In the analysis of the constitution of the crime and the determination of the crime, this paper focuses on the theoretical orientation of the crime of illegal practice of medicine, applies the theory of criminalization and decriminalization to interpret the crime of illegal practice of medicine, and insists on the balance between the necessity and the proportionality of the crime of illegal practice of medicine. For the exclusion of the crime of illegal medical practice, this paper discusses that the victim's commitment cannot be the reason for the illegal obstruction of the crime of illegal practice of medicine, and that the possibility of no expectation can be used as the reason for the exclusion of the crime of illegal practice of medicine. This article always runs through abandoning the concept of "omnipotence" of criminal law as the main legal means, insisting on the implementation of relevant principles of criminal law, in order to better reflect the spirit of modern criminal law and better conform to the crime of illegal practice of medicine.
