【摘要】： 隨著國際網(wǎng)絡技術(shù)的發(fā)展,互聯(lián)網(wǎng)在我國經(jīng)濟建設和人們生活中已得到了廣泛的應用,這使得人們的工作、學習和生活發(fā)生了質(zhì)的變化,互聯(lián)網(wǎng)已然成為了人們生活中必不可少的一部分。但隨著互聯(lián)網(wǎng)和信息技術(shù)的迅猛發(fā)展,網(wǎng)絡人口比例的增加,種種網(wǎng)絡問題也漸漸顯露出來,網(wǎng)絡犯罪作為一種新型犯罪凸現(xiàn),尤其是網(wǎng)絡經(jīng)濟犯罪可謂愈演愈烈。其中,網(wǎng)絡侵犯知識產(chǎn)權(quán)型犯罪、網(wǎng)絡銀行型犯罪、網(wǎng)絡涉眾型經(jīng)濟犯罪、網(wǎng)絡證券型犯罪、網(wǎng)絡購物稅款流失型犯罪等網(wǎng)絡經(jīng)濟犯罪對國家和人民的經(jīng)濟利益危害巨大,嚴重影響國家的經(jīng)濟秩序。我們要使國家經(jīng)濟秩序朝著正確的方向發(fā)展,就必須要了解和打擊網(wǎng)絡經(jīng)濟犯罪,因此,對其的研究越發(fā)顯得必要。本文試從以下幾方面對網(wǎng)絡經(jīng)濟犯罪進行淺析:第一章提出了網(wǎng)絡經(jīng)濟犯罪的概念,分別從網(wǎng)絡犯罪和經(jīng)濟犯罪的概念進行分析,明確了網(wǎng)絡犯罪、經(jīng)濟犯罪和網(wǎng)絡經(jīng)濟犯罪之間的關(guān)系;第二章結(jié)合犯罪本質(zhì)歸納了網(wǎng)絡經(jīng)濟犯罪區(qū)別于傳統(tǒng)犯罪的特點。如他的隱蔽性強化了人們的僥幸心理,他的高科技性減少了犯罪人的罪惡感,自認為是“天才的展示”,他的廣泛性增加了現(xiàn)實的危害性等。并通過對網(wǎng)絡經(jīng)濟犯罪的電子證據(jù)特點的分析,研究偵查和收集電子證據(jù)的方法;第三章結(jié)合網(wǎng)絡經(jīng)濟犯罪的特點及表現(xiàn)形式,從高額利益驅(qū)使、技術(shù)防范落后、立法滯后等方面剖析網(wǎng)絡經(jīng)濟犯罪的產(chǎn)生原因,并從完善立法、加強法制教育、強化管理等角度提出網(wǎng)絡經(jīng)濟犯罪的防范措施;第四章重點分析研究網(wǎng)絡侵犯知識產(chǎn)權(quán)型犯罪、網(wǎng)絡涉眾型犯罪等幾種危害性嚴重的網(wǎng)絡經(jīng)濟犯罪。通過對這幾種犯罪的性質(zhì)、特點和產(chǎn)生原因進行具體分析,尋找有針對性的治理辦法。筆者希望通過本文的論述,能夠給網(wǎng)絡經(jīng)濟犯罪的研究提供一些思路、尋找一些治理措施,從而找到有效防治和遏制網(wǎng)絡經(jīng)濟犯罪發(fā)生的方法,讓我們的網(wǎng)絡經(jīng)濟生活朝著更美好、更健康的目標前進。
[Abstract]:With the development of international network technology, the Internet has been widely used in China's economic construction and people's lives, which has made people's work, study and life have undergone a qualitative change. The Internet has become an essential part of people's lives. However, with the rapid development of Internet and information technology, the proportion of network population is increasing, and various network problems are gradually emerging. As a new type of crime, network crime, especially the crime of network economy, is becoming more and more serious. Among them, network crime of infringing intellectual property rights, network bank crime, network stakeholder type economic crime, network securities crime, network shopping tax loss crime and other network economic crimes do great harm to the economic interests of the country and the people. Seriously affect the country's economic order. If we want to make the national economic order develop in the right direction, we must understand and crack down on the crime of network economy, therefore, it is more and more necessary to study it. This article tries to analyze the crime of network economy from the following aspects: the first chapter puts forward the concept of the crime of network economy, analyzes the concept of network crime and economic crime, and clarifies the crime of network. The second chapter sums up the characteristics of the network economy crime which is different from the traditional crime according to the nature of the crime. For example, his concealment strengthens people's lucky psychology, his high-tech nature reduces the guilty feeling of the criminal, thinks that he is "the display of genius", and his universality increases the harmfulness of reality and so on. And through the analysis of the characteristics of the electronic evidence of the network economic crime, the paper studies the methods of investigation and collection of electronic evidence. Chapter three combines the characteristics and manifestations of the network economic crime, from the high profit driven, technical backwardness, This paper analyzes the causes of the network economic crime in the aspects of legislation lag, and puts forward the preventive measures of the network economic crime from the angles of perfecting the legislation, strengthening the legal system education and strengthening the management. Chapter four focuses on the analysis and study of the network crime of infringing intellectual property rights. Network stakeholder crime and other serious network economic crimes. Through the specific analysis of the nature, characteristics and causes of these crimes, this paper looks for targeted management methods. The author hopes that through the discussion of this article, it can provide some ideas for the research of network economic crime and find some measures to control it, so as to find an effective way to prevent and control the occurrence of network economic crime. Let us network economic life towards a better, healthier goal forward.
